Tenor

Der Vollstreckungsbescheid Geschäftsnummer ##### des Amtsgerichts I vom 19.06.2013 bleibt insoweit aufrechterhalten als der Beklagte in der Hauptforderung verurteilt wird, an die Klägerin 193,20 Euro zu zahlen (bestehend aus 123 Euro Schadenersatz gemäß Lizenzanalogie und 70,20 Euro Kosten der Abmahnung) nebst Zinsen in Höhe von fünf Prozentpunkten über dem Basiszinssatz ab dem 25.06.2010. Im Übrigen wird der Vollstreckungsbescheid Geschäftsnummer ##### des Amtsgerichts I aufgehoben und die Klage abgewiesen.

Die Kosten des Rechtsstreits tragen die Klägerin zu 90% und der Beklagte zu 10%.

Das Urteil ist vorläufig vollstreckbar. Die jeweilige Gegenseite kann die Vollstreckung durch Sicherheitsleistung in Höhe von 110% des jeweils zu vollstreckenden Betrages abwenden, wenn nicht die jeweils andere Seite zuvor Sicherheit in gleicher Höhe leistet.
