durch die Richterin am Amtsgericht X

für R e c h t erkannt:

Der Beklagte wird verurteilt, an die Klägerin 284,78 Euro nebst 5 % Zinsen über dem Basiszinssatz seit dem 08.03.10 zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Von den Kosten des Rechtsstreits trägt die Klägerin 77 %, der Beklagte

23 %.

Das Urteil ist vorläufig vollstreckbar.

Der Klägerin wird nachgelassen, die Zwangsvollstreckung gegen Sicherheitsleistung von 400,-- Euro abzuwenden, es sei denn, der Beklagte leistet vor der Vollstreckung Sicherheit in gleicher Höhe.

Dem Beklagten wird nachgelassen, die Zwangsvollstreckung gegen Sicher-heitsleistung von 300,-- Euro abzuwenden, es sei denn, die Klägerin leistet vor der Vollstreckung Sicherheit in gleicher Höhe.
