für Recht erkannt:

Die Beklagte wird verurteilt, an den Kläger 2.068,96 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 3.12.2008 zu zahlen.

Die weitergehende Klage wird abgewiesen.

Die Kosten des Rechtsstreits tragen der Kläger zu 15 % und die Beklagte zu 85 %.

Das Urteil ist für den Kläger gegen Sicherheitsleistung in Höhe von 110 % des beizutreibenden Betrages vorläufig vollstreckbar. Das Urteil ist für die Beklagte ohne Sicherheitsleistung vollstreckbar, dem Kläger wird aber nachgelassen, die Zwangsvollstreckung durch Sicherheitsleistung in Höhe von 110 % des beizutreibenden Betrages abzuwenden, wenn nicht die Beklagte vor der Vollstreckung Sicherheit in gleicher Höhe leistet.
