Die Beklagte wird verurteilt, an den Kläger 1.165,€ nebst Zinsen in Höhe von 5 Prozentpunkten über dem jeweiligen Basiszinssatz seit dem 16.9.2008 zu zahlen.

Die Kosten des Rechtsstreits trägt die Beklagte.

Das Urteil ist vorläufig vollstreckbar.

Die Beklagte darf die Zwangsvollstreckung durch Sicherheitsleistung in Höhe von 110 % des beizutreibenden Betrages abwenden, es sei denn, der Kläger leistet vor der Vollstreckung Sicherheit in gleicher Höhe.
