Der Beklagte wird verurteilt, an die Klägerin 182,42 € nebst Zinsen in Höhe von fünf Prozentpunkten über dem jeweiligen Basiszinssatz seit dem 08.08.2007 zu zahlen.
Der Beklagte wird weiter verurteilt, an die Klägerin vorgerichtliche Anwaltskosten in Höhe von 46,41 € nebst Zinsen in Höhe von fünf Prozentpunkten über dem jeweiligen Basiszinssatz seit dem 10.08.2008 zu zahlen.
Im Übrigen wird die Klage abgewiesen.
Die Kosten des Rechtsstreits tragen die Klägerin zu 71 % und die Beklagte zu
29 %.
Das Urteil ist vorläufig vollstreckbar.
