durch den Richter am Amtsgericht X

für R e c h t erkannt:

Es wird festgestellt, dass der Kläger nicht verpflichtet ist, an die Beklagte

aus dem am 2. Juni 2005 unterzeichneten Anzeigenauftrag Zahlungen

für eine 2. bis 13. Anzeige in der Schriftenreihe "XXX" zu

leisten.

Die Beklagte wird verurteilt, an den Kläger 206,48 € zzgl. Zinsen in Höhe

von 8 Prozentpunkten über dem Basiszinssatz seit dem 23. September

2005 sowie weitere 142,85 € zzgl. Zinsen in Höhe von 8 Prozentpunkten

über dem Basiszinssatz seit dem 23. September 2005 zu zahlen.

Die Beklagte hat die Kosten des Rechtsstreits zu tragen.

Das Urteil ist gegen Sicherheitsleistung in Höhe von jeweils 110 % des

jeweils zu vollstreckenden Betrages vorläufig vollstreckbar.
