für Recht erkannt:
Der Beklagte wird verurteilt, an die Klägerin 1.049,65 EUR zuzüglich
Zinsen in Höhe von 8 Prozentpunkten über dem Basiszinssatz aus
974,40 EUR seit dem 11.10.2005 und aus 75,25 EUR seit dem
17.11.2005 zu zahlen.
Die Kosten des Rechtsstreits werden dem Beklagten auferlegt mit
Ausnahme der durch die Anrufung des örtlich unzuständigen
Amtsgerichts Wolfenbüttel entstandenen Mehrkosten, die von der
Klägerin zu tragen sind.
Das Urteil ist vorläufig vollstreckbar. Der Beklagte darf die
Vollstreckung durch Sicherheitsleistung in Höhe von 110 % des
aufgrund dieses Urteils vollstreckbaren Betrages abzüglich 217,40 EUR
abwenden, wenn nicht die Klägerin vor der Vollstreckung Sicherheit in
gleicher Höhe leistet.
Dem Beklagten bleibt die Ausführung seiner Rechte im Nachverfahren
vorbehalten, soweit er über einen Betrag von 217,40 EUR hinaus
verurteilt worden ist.
