für R e c h t erkannt:
Die Beklagte wird verurteilt, an die Klägerin 2.965,00 EUR nebst 5% Zinsen
über dem Basiszinssatz aus 465,00 EUR seit dem 27. September 2004 sowie
vorgerichtliche Anwaltsgebühren in Höhe von 186,82 EUR zu zahlen.
Im Übrigen wird die Klage abgewiesen.
Die Kosten des Rechtsstreits tragen die Klägerin zu 6/100 sowie die Beklagte
zu 94/100.
Das Urteil ist für die Klägerin gegen Sicherheitsleistung in Höhe von 110 %
des zu vollstreckenden Betrages und für die Beklagte ohne Sicherheitsleis-
tung vorläufig vollstreckbar.
Die Sicherheitsleistung kann auch durch die selbstschuldnerische Bürgschaft
einer Deutschen Bank oder Sparkasse erbracht werden.
