für R e c h t erkannt:

Die Beklagte wird verurteilt, der Erhöhung der Nettomiete für die Wohnung Nr.

016 010 11, EDV-Nr. 5203+009, X-straße 27 in X, Erd-

geschoss links, von bisher monatlich 363,00 EUR auf nunmehr monatlich

435,60 EUR mit Wirkung ab dem 01.10.2003 zuzustimmen.

Die Kosten des Rechtsstreits trägt die Beklagte.

Das Urteil ist vorläufig vollstreckbar. Die Beklagte kann die Vollstreckung durch

Sicherheitsleistung in Höhe von 2.500,00 EUR abwenden, wenn nicht die Kläge-

rin vor der Vollstreckung Sicherheit in gleicher Höhe leistet.
