Der Beklagte wird verurteilt, an den Kläger 349,95 EUR nebst Zinsen in Höhe von
fünf Prozentpunkten über dem jeweiligen Basiszinssatz seit dem 16.6.2002 zu
zahlen.
Im Übrigen wird die Klage abgewiesen.
Die Kosten des Rechtsstreits trägt der Kläger zu 7 % und der Beklagte zu
93 %.
Das Urteil ist vorläufig vollstreckbar.
Die Wiedergabe des Tatbestandes entfällt nach § 313 a Abs. 1 Satz 1 ZPO, weil ge-gen das Urteil ein Rechtsmittel nicht zulässig ist.
