für R e c h t erkannt:
Die Beklagte wird verurteilt, an die Klägerin – Zug um Zug gegen Zahlung der Kosten in Höhe von 69,90 € (0,30 € je Seite) – die gesamten über die Klägerin gefertigten Behandlungsunterlagen für den Zeitraum von Januar 2000 bis 08.04.2000 in Kopie herauszugeben. Im übrigen wird die Klage abgewiesen.
Die Kosten des Rechtsstreits trägt die Klägerin zu 36 % und die Beklagte zu 64 %.
Das Urteil ist vorläufig vollstreckbar, für die Klägerin jedoch nur gegen Sicherheitsleistung in Höhe von 4.000 €. Die Klägerin kann die Vollstreckung abwenden durch Sicherheitsleistung in Höhe von 110 % des aus dem Urteil vollstreckbaren Betrags, wenn nicht die Beklagte vor der Vollstreckung Sicherheit in Höhe von 110 % des jeweils zu vollstreckenden Betrags leistet.
