Tenor

hat das Amtsgericht Düsseldorf

auf die mündliche Verhandlung vom 31. Juli 2001

durch den Richter am Amtsgericht X

für R e c h t erkannt:

Die Beklagte wird verurteilt, an den Kläger

1.793,60 DM nebst Zinsen in Höhe von 5 Pro-

zentpunkten über dem Basiszinssatz seit dem

  1. September 2000 zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreites tragen der Klä-

ger zu 45/100 sowie die Beklagte zu 55/100.

Das Urteil ist vorläufig vollstreckbar.

Die Beklagte kann die Zwangsvollstreckung

durch den Kläger gegen Sicherheitsleistung in

Höhe von 3.000,-- DM abwenden, sofern der Klä-

ger vor der Vollstreckung nicht Sicherheit in

gleicher Höhe leistet.

Die Sicherheitsleistung kann auch durch die

selbstschuldnerische Bürgschaft einer deut-

schen Bank oder Sparkasse erbracht werden.
