Tenor

hat das Amtsgericht Düsseldorf -Abteilung 34-

auf die mündliche Verhandlung vom 8. Oktober 1998

durch die Richterin am Amtsgericht X

für R e c h t erkannt:

Die Beklagte wird verurteilt, an den Kläger 2.312,58 DM nebst

4 % Zinsen seit dem 28.6.1997 zu zahlen; im übrigen wird die

Klage abgewiesen.

Die kosten des Rechtsstreits tragen der Kläger zu 13 %, die

Beklagte zu 87 %.

Das Urteil ist vorläufig vollstreckbar, für den Kläger gegen

Sicherheitsleistung in Höhe von 3.300,--DM, für die Beklagte

gegen Sicherheitsleistung in Höhe von 150,--DM.

Die Sicherheitsleistung darf je durch selbstschuldnerische Bürgschaft

einer deutschen Bank oder Sparkasse erbracht werden.
