Omnilex summary

In proceedings concerning alleged dissemination of pornographic writings, Bocholt Local Court refused to open the main proceedings on factual grounds. The court stated that storage of child pornography on a computer gives rise to a factual presumption that the computer’s owner possesses the data. That presumption may be rebutted where third parties had access to the computer and the owner need not have known that the data were present. The State Treasury was ordered to bear the procedural costs and necessary expenses.
