Omnilex summary

N I applied on 10 March 2014 for refusal to confirm an insolvency plan dated 19 March 2014. The Bonn District Court rejected the application. It stated that an application under § 251 InsO requires alleged and substantiated facts showing that the applicant is more likely than not to be worse off under the plan than in ordinary insolvency proceedings. The applicant must address the plan’s comparative calculation. The court found the application insufficient under that standard.

Omnilex headnote

§ 251 InsO; an application to refuse confirmation of an insolvency plan on the ground of disadvantage is admissible only where the alleged and substantiated facts establish a predominant probability that the applicant would fare worse under the plan than in ordinary insolvency proceedings. The applicant must engage with the comparative calculation included in the plan; a bare assertion of disadvantage, without sufficiently addressing that calculation, does not meet the statutory threshold.
