Omnilex summary

The plaintiff sought repayment under BGB § 812(1) of a processing fee paid in connection with a consumer loan. The Bonn District Court dismissed the action as time-barred. It held that limitation began at the end of the year in which the loan was disbursed and that divergent judicial decisions about repayment claims for such fees did not warrant postponing the start of limitation. The plaintiff was ordered to bear the costs. The judgment was declared provisionally enforceable, subject to the stated security arrangements.

Omnilex headnote

BGB § 812(1), § 199(1); commencement of limitation for restitution of a consumer-loan processing fee. The limitation period for a claim to recover a processing fee paid under a consumer-loan agreement begins at the end of the year in which the loan was disbursed. Divergence in the case law concerning the recoverability of such fees does not, by itself, defer commencement of limitation. The existence of differing judicial views therefore does not justify treating the creditor’s knowledge, or the legal uncertainty surrounding the claim, as a basis for a later limitation start.
