Omnilex summary

Bonn District Court allocated the costs of the proceedings to the respondent under § 91a ZPO. The stated legal principle concerns a telecommunications contract terminated at the end of its agreed term because the customer is switching providers: if the new provider is not yet able to provide service because contractual and technical prerequisites are missing, both the former and new providers must continue the existing services under § 46(1) TKG. The court set the value in dispute at up to EUR 1,200 through 3 June 2013 and thereafter at the amount represented by the costs interest.

Omnilex headnote

§ 46(1) TKG; continuity of telecommunications service during a provider change. Where a telecommunications contract is terminated at the end of the agreed service period because of a provider change, and the contractual and technical prerequisites for service by the new provider are not yet in place, both the former and the new provider are obliged to continue providing the existing services. The provision ensures continuity during the transition and applies until the new provider can take over service.
