Omnilex summary

The Kerpen District Court dismissed the plaintiff’s claim concerning an eBay auction. The other user had registered with fictitious personal details that referred to no existing person. The court held that a user who registers using false data cannot effectively participate in eBay auctions. Because auction offers are directed only to users registered in compliance with eBay’s terms of use, no contract formed through that user’s participation. The plaintiff was ordered to bear the litigation costs; the judgment was declared provisionally enforceable.

Omnilex headnote

The formation of a contract through an online auction requires participation by a person to whom the auction offer is addressed. Where a user registers with fictitious personal data referring to no existing person, the user has not registered in accordance with the platform’s terms of use and cannot effectively participate in the auction. Those terms are relevant not only to the circumstances in which an auction may be cancelled, but also to whether a contract has come into existence. See also BGH, judgment of 8 June 2011, VIII ZR 305/10.
