Omnilex summary

The Kerpen Local Court addressed whether approval of annual condominium accounts also makes binding the advance-payment amounts recorded in the individual accounts. It held that those amounts do not participate in the finality of the approval resolution. Inferring such an additional resolution would be a fiction, and could expose both the condominium community—particularly where accounts use target advance payments—and individual owners to unacceptable legal disadvantages.

Omnilex headnote

WEG (old version) § 23(4), first sentence; scope of the finality of a resolution approving annual condominium accounts. Approval of annual accounts does not make final the advance-payment amounts shown in individual accounts. Such a consequence cannot be inferred from the approval resolution: it would fictitiously attribute to the owners an intention to resolve on the correctness of advance payments recorded for other owners. Moreover, binding those amounts risks unacceptable legal disadvantages for both the condominium community, especially where accounting is based on target advance payments, and individual owners.

The amounts of advance payments stated in individual accounts do not acquire finality through the resolution approving the annual accounts.

It would be a legal fiction to infer that owners intended to resolve on the correctness of advance payments shown in other owners’ accounts; treating them as binding could cause unacceptable legal disadvantages to both the condominium community and individual owners.
