Omnilex summary

Applicants 1 and 2 sought approval of a farm transfer and lifetime-support contract, including an amendment. The Beckum Local Court refused approval. It found that the transfer conditions would severely constrain the transferee’s independent management of the farm: a conditional retransfer obligation secured by a priority notice could prevent access to investment loans. The arrangement also provided for retransfer after the transferor’s death to the transferor’s wife, thereby excluding first-order farm heirs in favor of a second-order heir. Each applicant was ordered to bear half of the procedural costs, with no order for reimbursement of extrajudicial costs.

Omnilex headnote

§ 9(1) no. 1 and § 9(2) GrdstVG; prohibition of an unhealthy distribution of land in the case of a farm transfer. Approval may be refused where the contractual structure conflicts with measures to improve agricultural structure by substantially restricting the transferee’s independent operation of the farm. A conditional duty to retransfer, secured by a priority notice, may impair that independence where it prevents the transferee from obtaining investment loans. A provision requiring retransfer after the transferor’s death to the transferor’s spouse may also be objectionable where it excludes first-order farm heirs in favor of a second-order heir. The decisive concern is whether the arrangement undermines independent agricultural management or produces an impermissible succession outcome.

Approval was refused because the transfer arrangements substantially constrained the transferee’s independent farm management and affected the statutory succession of heirs.

A secured conditional obligation to retransfer the farm impedes the transferee’s ability to obtain investment credit and operate independently. The retransfer arrangement also excludes first-order farm heirs in favor of a second-order heir.

Applicants 1 and 2 must each bear half of the procedural costs; no reimbursement of extrajudicial costs is ordered.
