Tenor

Es wird festgestellt, dass der zwischen den Parteien bestehende Bausparvertrag mit der Vertragsnummer XXXX XXXX XX durch die Kündigung der Beklagten vom XX.10.2016 nicht beendet wurde, sondern über den 31.12.2016 hinaus unverändert fortbesteht.

Die Beklagte wird außerdem verurteilt, den Kläger von dern durch die außergerichtliche Tätigkeit der Rechtsanwaltskanzlei Q, T-Straße X, XXXXX L-Stadt entstandenen Rechtsanwaltskosten in Höhe von 382,59 € freizuhalten.

Die Kosten des Rechtsstreits trägt die Beklagte.

Das Urteil ist hinsichtlich des Feststellungstenors gegen Sicherheitsleistung in Höhe von 2.850,00 € und im Übrigen gegen Sicherheitsleistung in Höhe von 110 % des jeweils zu vollstreckenden Betrags vorläufig vollstreckbar.
