Tenor

  1. Der Beklagte wird verurteilt, in dem zur Wohnung der Klägerin mit der Nr. 2.3 im Objekt V-straße 1a, B-Stadt, gehörenden Kellerraum (mit dem Rücken zur Eingangstür des Kellerbereichs stehend gesehen der zweite Raum links auf der linken Seite) Maßnahmen zu treffen, die eine Aufbewahrung von Gegenständen ermöglichen, ohne dass diese von Schimmel befallen werden.

  2. Der Beklagte wird

verurteilt, an die Klägerin 301,77 EUR (in Worten: dreihundertein Euro und siebenundsiebzig Cent) nebst Zinsen in Höhe von 5 Prozentpunkten über dem jeweiligen Basiszinssatz seit dem 25.07.2015 zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits werden gegeneinander aufgehoben.

Dieses Urteil ist für die Klägerin gegen Sicherheitsleistung in Höhe von 1.500,00 EUR vorläufig vollstreckbar.

Der Klägerin hat das Gericht gestattet, die Zwangsvollstreckung gegen Sicherheitsleistung in Höhe von 120 % des vollstreckbaren Betrages abzuwenden, wenn nicht der Beklagte vor der Zwangsvollstreckung Sicherheit in Höhe von 120 % des zu vollstreckenden Betrages leistet.
