  1. Die Beklagte wird verurteilt, an den Kläger 1.573,20 € nebst 5 % Zinsen über

dem Basiszinssatz aus 981,17 € seit dem 15.5.2002 und aus weiteren 592,03 € seit dem 2.8.2002 zu zahlen. Im übrigen wird die Klage abgewiesen.

  1. Von den Kosten des Rechtsstreits tragen 63 % der Kläger und 37 % die Be-klagte.

  2. Das Urteil ist vorläufig vollstreckbar, für den Kläger jedoch nur gegen 110 %
