I.

Der Beklagte wird verurteilt, an die Klägerin einen Betrag in Höhe von 869,20 Euro nebst 4 % Zinsen hieraus seit dem 12.08.1999 zu bezahlen.

II.

Im übrigen wird die Klage abgewiesen.

III.

Von den Kosten des Rechtsstreites trägt die Klägerin 23 %, der Beklagte 77 %.

IV.

Dieses Urteil ist vorläufig vollstreckbar. Die Klägerin und der Beklagte können jedoch jeweils die Vollstreckung gegen sich durch Sicherheitsleistung in Höhe von 110 % des aufgrund des Ur-teils gegen sie vollstreckbaren Betrages abwenden, wenn nicht die vollstreckende Partei je-weils Sicherheit in eben dieser Höhe leistet.
