Tenor

Der Beklagte wird verurteilt, an den Kläger 684, 06 DM nebst 4 % Zinsen seit dem 29.01.1993 zu zahlen.

Im übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits hat der Beklagte zu 24 % und der Kläger zu 76 % zu tra-gen.

Die Kosten der Streithelferin hat diese selbst zu 24 % und der Kläger zu 76 % zu tra-gen.

Das Urteil ist vorläufig vollstreckbar.

Der Kläger darf die Vollstreckung des Beklagten durch Sicherheitsleistung in Höhe von 600,00 DM abwenden, wenn nicht der Beklagte vor der Vollstreckung Sicherheit in gleicher Höhe leistet. Der Kläger darf die Vollstreckung der Streitverkündeten durch Si-cherheitsleistung in Höhe von 100,00 DM abwenden, wenn nicht der Streitverkündete vor der Vollstreckung Sicherheit in gleicher Höhe leistet.

Den Parteien bleibt nachgelassen, eine Sicherheitsleistung auch in Form einer selbst-schuldnerischen Bürgschaft einer deutschen Großbank oder Sparkasse zu erbringen.
