A._____, Gesuchsteller

betreffend Gesuch um unentgeltliche Rechtspflege

Erwägungen: 1. A._____ (nachfolgend: Gesuchsteller) machte am 30. Oktober 2013 beim Friedensrichteramt Thalwil ein Schlichtungsbegehren anhängig betreffend eine Forderungsklage gegen B._____. Mit Verfügung vom 12. November 2013 setzte ihm das Friedensrichteramt Thalwil Frist an, um einen Kostenvorschuss von Fr. 525.- zu leisten (act. 2/1). In der Folge ersuchte der Gesuchsteller mit Eingabe vom 26. November 2013 beim Präsidenten des Obergerichts des Kantons Zürich sinngemäss um Gewährung der unentgeltlichen Rechtspflege für das genannte Schlichtungsverfahren (act. 1). 2. Mit Schreiben vom 17. Dezember 2013 zog der Gesuchsteller das von ihm eingereichte Schlichtungsbegehren beim Friedensrichteramt Thalwil vorbehaltlos zurück, woraufhin das Friedensrichteramt Thalwil das Schlichtungsverfahren mit Verfügung vom 19. Dezember 2013 als durch Rückzug erledigt abschrieb und keine Gerichtskosten sprach (vgl. act. 8). Da dem Gesuchsteller demzufolge im Schlichtungsverfahren keine Kosten auferlegt wurden, erweist sich sein Gesuch um Gewährung der unentgeltlichen Rechtspflege für das Schlichtungsverfahren als gegenstandslos. Das vorliegende Verfahren ist somit zufolge Gegenstandlo- sigkeit als erledigt abzuschreiben. 3. Gemäss Art. 119 Abs. 6 ZPO ist das Verfahren um unentgeltliche Rechts- pflege kostenlos. 4. Dieser Entscheid kann mit Beschwerde gemäss Art. 121 ZPO beim Oberge- richt angefochten werden. Dass vorliegend der Obergerichtspräsident über das Gesuch befindet, vermag daran nichts zu ändern. Der Obergerichtspräsident fällt in diesem Verfahren einen erstinstanzlichen Entscheid i.S.v. Art. 319 lit. b ZPO und fungiert nicht als obere kantonale Instanz, gegen deren Entscheide lediglich ein Rechtsmittel ans Bundesgericht gegeben wäre.

Es wird verfügt: 1. Das Verfahren wird zufolge Gegenstandslosigkeit als erledigt abgeschrie- ben. 2. Dieses obergerichtliche Verfahren ist kostenlos. 3. Schriftliche Mitteilung je gegen Empfangsschein an: − den Gesuchsteller − den Beistand des Gesuchstellers C., ..., ... [Adresse] − das Friedensrichteramt Thalwil (GV.2013.00073), Alte Landstr. 110b, 8800 Thalwil − die Gegenpartei in der Hauptsache, B., ... [Adresse] 4. Eine Beschwerde gegen diesen Entscheid kann innert 10 Tagen von der Zustellung an im Doppel und unter Beilage dieses Entscheids beim Oberge- richt des Kantons Zürich, Zivilkammern, Postfach 2401, 8021 Zürich, einge- reicht werden. In der Beschwerdeschrift sind die Anträge zu stellen und zu begründen. Allfällige Urkunden sind mit zweifachem Verzeichnis beizulegen. Die gesetzlichen Fristenstillstände gelten nicht (Art. 145 Abs. 2 ZPO).
