Omnilex summary

The Zurich High Court noted that the appellant withdrew his appeal on 2 March 2017 against the first-instance ruling on costs. It therefore struck the appeal proceedings off the docket under Art. 241(3) CPC. Given the circumstances, it waived court costs and awarded no party compensation. The decision also set out the Federal Supreme Court remedies and confirmed that the matter was a final decision in a pecuniary dispute with a value in dispute of CHF 100.

Omnilex headnote

Art. 241 Abs. 3 ZPO; withdrawal of the appeal in appellate proceedings: when the appellant withdraws the remedy, the court strikes the proceedings off the record as moot. Court costs may be waived in view of the circumstances; party compensation is governed by Art. 95 Abs. 3 and Art. 106 Abs. 1 ZPO and is not awarded absent a basis therefor. A withdrawal does not entail a substantive merits decision but terminates the appellate proceedings procedurally (consid. 1-2).
