Conditional withdrawal in conciliation does not bar a new claim

Omnilex summary

The claimant challenged an order of the justice of the peace that treated her post-hearing statement as a provisional withdrawal and discontinued the proceedings. The Obergericht held that any alleged invalidity of a settlement, claim withdrawal, or acknowledgment of claim must be raised by revision before the court that last decided the case, here the Friedensrichteramt Bülach. It therefore lacked subject-matter jurisdiction and did not enter into the request. It further noted that a withdrawal 'under reservation' in conciliation does not extinguish the substantive claim; only the conciliation request is withdrawn, so the claimant remains free to bring the action again.

Omnilex headnote

Art. 208 CPC; Art. 328 Abs. 1 lit. c CPC; challenge to the invalidity of a claim withdrawal and effect of a conditional withdrawal in conciliation: defects affecting a settlement, claim withdrawal or acknowledgment must be asserted by revision before the court that decided last on the merits. The appellate court lacks jurisdiction to review such allegations by appeal or complaint. A withdrawal made only 'provisionally' in conciliation, without preclusive effect, is not an unconditional withdrawal of the action but merely a withdrawal of the conciliation request; the substantive claim may be filed anew (consid. 2).

Art.208 Abs. 2 ZPO, Art. 59 Abs. 2 lit. e ZPO.

Key legal question

Whether the cantonal appellate court had jurisdiction to review the alleged invalidity of the withdrawal of claim in conciliation proceedings.

Extracted holding

No. A challenge to the invalidity of a settlement, claim withdrawal, or acknowledgment of claim must be brought by revision before the court that decided the matter last on the merits; the appellate court is not competent.

Extracted reasoning

Under Art. 328(1)(c) CPC, defects affecting a claim withdrawal are to be asserted by revision. Revision lies with the court that rendered the last decision in the matter. By contrast, appeal and complaint are to be filed with the appellate court. Therefore, the justice of the peace, not the Obergericht, was competent.

Key legal question

Whether a withdrawal made 'provisionally' in conciliation has preclusive effect on the merits claim.

Extracted holding

No. A withdrawal made only 'provisionally' is not an unconditional withdrawal of the claim but merely a withdrawal of the conciliation request; the claimant may file the claim again.

Extracted reasoning

Art. 208 CPC applies to conciliation proceedings. The court held that a withdrawal under reservation without blocking effect concerns only the conciliation request, not the substantive claim itself.
