Beschwerde gegen ein Urteil des Einzelgerichts Audienz am Bezirksgericht Zürich vom 24. November 2016 (EB161712-L)

Erwägungen: Mit Schreiben vom 22. Dezember 2016, beim Obergericht eingegangen am 23. Dezember 2016, zog die Beschwerdeführerin die Beschwerde zurück (Urk. 11). Das Verfahren ist entsprechend abzuschreiben. Mit dem Rückzug wird auch die erstinstanzliche Regelung der Kosten- und Entschädigungsfolge rechtskräftig. Ausgangsgemäss sind die Prozesskosten des Rechtsmittelverfahrens der Beschwerdeführerin aufzuerlegen. Mangels erhebli- cher Umtriebe ist der Beschwerdegegnerin für das Rechtsmittelverfahren keine Parteientschädigung zuzusprechen. Es wird beschlossen: 1. Das Verfahren wird abgeschrieben. 2. Die zweitinstanzliche Entscheidgebühr wird auf Fr. 300.– festgesetzt. 3. Die Gerichtskosten des Rechtsmittelverfahrens werden der Beschwerdefüh- rerin auferlegt. 4. Es werden keine Parteientschädigungen zugesprochen. 5. Schriftliche Mitteilung an die Parteien, an die Beschwerdegegnerin unter Beilage je eines Doppels von Urk. 6, Urk. 8, Urk. 9/2-8 und einer Kopie der Urk. 11, sowie an die Vori nstanz, je gegen Empfangsschein. Die erstinstanzlichen Akten gehen nach unbenütztem Ablauf der Rechtsmit- telfrist an die Vorinstanz zurück. 6. Eine Beschwerde gegen diesen Entscheid an das Bundesgericht ist i nnert 30 Tagen von der Zustellung an beim Schweizerischen Bundesgeri cht, 1000 Lausanne 14, einzureichen. Zulässigkeit und Form einer solchen Be- schwerde ri chten si ch nach Art. 72 ff. (Beschwerde in Zivilsachen) oder

Art. 113 ff. (subsidiäre Verfassungsbeschwerde) in Verbindung mit Art. 42 des Bundesgesetzes über das Bundesgericht (BGG). Dies ist ein Endentscheid im Sinne von Art. 90 BGG. Es handelt sich um eine vermögensrechtliche Angelegenheit. Der Streitwert beträgt Fr. 51'542.05. Die Beschwerde an das Bundesgericht hat keine aufschiebende Wirkung. Hinsichtlich des Fristenlaufs gelten die Art. 44 ff. BGG.
