The Obergericht held that, after the opening of bankruptcy, pending enforcement proceedings are generally lifted and related civil proceedings are stayed under Art. 207 SchKG unless they are urgent. It reasoned that the urgency of an action under Art. 85a SchKG stems only from its connection to the enforcement proceeding; once that enforcement is terminated by bankruptcy, the special urgency disappears. Such an action is therefore generally not urgent within the meaning of Art. 207 Abs. 1 SchKG.
Art. 207 Abs. 1 SchKG; Urgent civil proceedings in bankruptcy; an action under Art. 85a SchKG is, as a rule, not urgent. Urgency in the sense of Art. 207 Abs. 1 SchKG requires that the nature of the dispute or subject matter necessitates immediate adjudication independently of the bankruptcy procedure. Where the urgency of the action is merely derivative of the underlying enforcement proceedings, the opening of bankruptcy and the resulting lifting of the enforcement under Art. 206 Abs. 1 SchKG extinguish that urgency; the proceeding is then subject to stay.
Art. 207 SchKG, Dringliches. Eine Klage nach Art. 85a SchKG ist grundsätzlich nicht dringlich im Sinne der Bestimmung.
