Art. 450b Abs. 2 ZGB, Beschwerde im Bereich der Fürsorgerischen Unter- bringung; Art. 239 ZPO, Mitteilung des Entscheides nur im Dispositiv. Frist zum Erheben und Begründen des Rechtsmittels.

Die Einzelgerichte eröffnen mitunter ihre Entscheide über eine Fürsorgeri- sche Unterbringung sofort nach der Verhandlung durch Übergabe des Dis- positives. Frist zum Erheben und Begründen eines Rechtsmittels, wenn in dem Dispositiv nicht auf die Frist von Art. 239 Abs. 2 ZPO zum Verlangen einer Begründung hingewiesen, sondern direkt ein später zuzustellendes vollständiges (begründetes) Urteil in Aussicht gestellt wird.

Die Beschwerde gegen die fürsorgerische Unterbringung ist innert der 10- tägigen Frist von Art. 450b Abs. 2 ZGB beim Obergericht schriftlich einzureichen. Die Vorinstanz wies in ihrer Rechtsmittelbelehrung (sowohl im übergebenen Dis- positiv als auch im später zugestellten begründeten Entscheid) darauf hin, eine Beschwerde gegen das Urteil könne innert 10 Tagen von der Eröffnung des Ent- scheids an erhoben werden. Diese Formulierung ist insofern missverständlich, als die Eröffnung des Entscheids bereits mit Übergabe des Dispositivs erfolgt (vgl. Art. 239 ZPO). Es ist daher klarzustellen, dass die Beschwerdefrist - auch bei vorgängiger Mitteilung des Entscheids im Dispositiv - erst ab Zustellung des be- gründeten Entscheids zu laufen beginnt. Denn von der Beschwerde führenden Partei kann nach Treu und Glauben (Art. 52 ZPO) nicht verlangt werden, die Be- schwerde in Unkenntnis der Begründung des angefochtenen Entscheids zu ver- fassen (vgl. dazu OGerZH NA110008 vom 24. März 2014, zwar noch zum alten kantonalen Recht, aber nach wie vor gültig). Entsprechend wurde die Beschwer- deführerin auf die Möglichkeit hingewiesen, ihre Beschwerdebegründung innert zehn Tagen nach Zustellung des begründeten Entscheids zu ergänzen.
