Berufung gegen eine Verfügung des Einzelgerichts im ordentlichen Verfahren am Bezirksgericht Bülach vom 21. Oktober 2013 (FE120101-C)

Erwägungen: 1. Mit Eingabe vom 13. Dezember 2013, beim Obergericht eingegangen am 16. Dezember 2013, hat die Beklagte die Berufung zurückgezogen (Urk. 8). Das Berufungsverfahren ist entsprechend abzuschreiben. 2. Die Beklagte hat für das Berufungsverfahren kein Gesuch um unent- geltliche Rechtspflege gestellt (Urk. 1 S. 1 ff.; vgl. Art. 119 Abs. 5 ZPO). Aus- gangsgemäss sind die Gerichtskosten des Berufungsverfahrens der Beklagten aufzuerlegen (Art. 106 Abs. 1 ZPO). Mangels relevanter Umtriebe ist dem Kläger und der Verfahrensbeteiligten für das Berufungsverfahren keine Parteientschädi- gung zuzusprechen. Es wird beschlossen: 1. Das Berufungsverfahren wird abgeschrieben. 2. Die zweitinstanzliche Entscheidgebühr wird auf Fr. 500.-- festgesetzt. 3. Die Gerichtskosten des Berufungsverfahrens werden der Beklagten aufer- legt. 4. Für das Berufungsverfahren werden keine Parteientschädigungen zuge- sprochen. 5. Schriftliche Mitteilung an die Parteien, an den Kläger und die Verfahrensbe- teiligte unter Beilage eines Doppels von Urk. 1 und 8, sowie an die Vorinstanz, je gegen Empfangsschein. 6. Eine Beschwerde gegen diesen Entscheid an das Bundesgericht ist innert 30 Tagen von der Zustellung an beim Schweizerischen Bundesgericht,

1000 Lausanne 14, einzureichen. Zulässigkeit und Form einer solchen Be- schwerde richten sich nach Art. 72 ff. (Beschwerde in Zivilsachen) oder Art. 113 ff. (subsidiäre Verfassungsbeschwerde) in Verbindung mit Art. 42 des Bundesgesetzes über das Bundesgericht (BGG). Dies ist ein Entscheid über vorsorgliche Massnahmen im Sinne von Art. 98 BGG. Es handelt sich um eine nicht vermögensrechtliche Angelegenheit. Die Beschwerde an das Bundesgericht hat keine aufschiebende Wirkung. Hinsichtlich des Fristenlaufs gelten die Art. 44 ff. BGG.
