Berufung gegen eine Verfügung des Einzelgerichts im summarischen Verfahren am Bezirksgericht Andelfingen vom 1. Juli 2015 (EE150003-B)

Erwägungen: Mit Schreiben vom 28. Juli 2015, beim Obergericht am 29. Juli 2015 ei nge- gangen, zog der Beklagte die Berufung zurück. Das Verfahren ist entsprechend abzuschreiben. Die mit Verfügung vom 23. Juli 2015 (Urk. 7) verliehene aufschie- bende Wirkung entfällt damit. Ausgangsgemäss sind die Prozesskosten des Rechtsmittelverfa hre ns dem Beklagten aufzuerlegen, wobei in Bezug auf den Aufwand des Gerichtes zu be- achten ist, dass mit Verfügung vom 23. Juli 2015 bereits über das Gesuch des Beklagten um superprovisorische Gewährung der aufschiebenden Wirkung ent- schieden wurde (Urk. 7). Aufgrund dieses Gesuches hatte die Klägerin eine Stel- lungnahme "in der gebotenen Kürze" (Urk. 7 S. 7) zu verfassen (Urk. 9; hierorts am 28. Juli 2015 eingegangen), weshalb ihr für das Berufungsverfahren eine Par- teientschädigung von Fr. 1'000.– (zuzügli ch 8 % Mehrwertsteuer) zuzusprechen ist . Es wird beschlossen: 1. Das Verfahren wird abgeschrieben. Damit entfällt die der Berufung verliehe- ne aufschiebende Wirkung. 2. Die Entscheidgebühr für das Berufungsverfa hre n wird auf Fr. 1'200.– festge- setzt. 3. Die Gerichtskosten des Berufungsverfahrens werden dem Beklagten aufer- legt. 4. Der Klägerin wird für das Berufungsverfahren eine Parteientschädigung von Fr. 1'080.– zugesprochen.

Eine Beschwerde gegen diesen Entscheid an das Bundesgericht ist i nnert 30 Tagen von der Zustellung an beim Schweizerischen Bundesgericht, 1000 Lausanne 14, einzureichen. Zulässigkeit und Form einer solchen Be- schwerde ri chten si ch nach Art. 72 ff. (Beschwerde in Zivilsachen) oder Art. 113 ff. (subsidiäre Verfassungsbeschwerde) in Verbindung mit Art. 42 des Bundesgesetzes über das Bundesgericht (BGG). Dies ist ein Zwischenentscheid im Sinne von Art. 93 BGG. Es handelt sich um eine nicht vermögensrechtliche Angelegenheit. Die Beschwerde an das Bundesgericht hat keine aufschiebende Wirkung. Hinsichtlich des Fristenlaufs gelten die Art. 44 ff. BGG.
