Nach Einsicht in das nachfolgende Rechtsbegehren der Klägerin vom 13. De- zember 2012 (act. 1 S. 2): "Das Grundbuchamt C._____ sei anzuweisen, zugunsten der Klägerin auf dem Grundstück der Beklagten Kat. Nr. ... Grundbuchblatt ... im Stadtquartier C._____ ein Bauhandwerkerpfandrecht im Betrag von Fr. 1'171'212.-- zuzüglich Zins zu 5 % seit 27. Dezember 2012 vorläufig im Grundbuch vorzumerken; Unter Kosten- und Entschädigungsfolgen zu Lasten der Beklagten."

mit dem Hinweis, - dass das Handelsgericht des Kantons Zürich das beantragte Bauhandwer- kerpfandrecht mit Verfügung vom 17. Dezember 2012 für eine Pfandsumme von CHF 1'171'212.-- nebst Zins zu 5 % seit 27. Dezember 2012 auf Liegen- schaft Kat. Nr. ..., GBBl. ... , D.-Strasse ..., E., vorläufig im Grundbuch eintragen liess (act. 4), - dass der Beklagten mit Verfügung vom 17. Dezember 2012 Frist zu Stel- lungnahme zum klägerischen Begehren angesetzt wurde (act. 4), - und dass innert Frist keine Stellungnahme der Beklagten eingegangen ist, weshalb aufgrund der Akten zu entscheiden ist (act. 4 S. 2), da aufgrund der Eingabe der Klägerin und der eingereichten Unterlagen (act. 1 und 3/1-17) als glaubhaft erscheint, - dass sie für die eingetragene Pfandsumme auf dem Grundstück der Beklag- ten im Sinne von Art. 837 Abs. 1 Ziff. 3 ZGB Material geliefert und Arbeit ge- leistet hat, und - dass die Klägerin die Arbeiten am 31. August 2012 abgeschlossen hat, die Viermonatsfrist gemäss Art. 839 Abs. 2 ZGB mit der vorläufigen Eintragung am 17. Dezember 2012 somit gewahrt ist;

erkennt das Einzelgericht: 1. Die einstweilige Anweisung an das Grundbuchamt C._____ wird bestätigt als vorläufige Eintragung im Sinne von Art. 961 ZGB mit Wirkung ab vorläu- figer Eintragung gemäss Verfügung vom 17. Dezember 2012 bis zur rechts- kräftigen Erledigung des gemäss Dispositiv-Ziffer 2 einzuleitenden Prozes- ses auf Liegenschaft Kat. Nr. ..., GBBl. ... , D.-Strasse ..., E. für eine Pfandsumme von CHF 1'171'212.-- nebst Zins zu 5 % seit 27. Dezember 2012. 2. Der Klägerin wird Frist bis 29. April 2013 angesetzt, um eine Klage auf Fest- stellung der Forderung als Pfandsumme und definitive Eintragung des Pfandrechts gegen die Beklagte anzuheben. Bei Säumnis kann die Beklagte den vorläufigen Eintrag (Dispositiv-Ziffer 1) löschen lassen. 3. Die Gerichtsgebühr beträgt CHF 8'000.--. 4. Die Kosten werden von der Klägerin bezogen. Vorbehalten bleibt der end- gültige Entscheid des Gerichts im ordentlichen Verfahren. Für den Fall, dass die Klägerin innert Frist gemäss Dispositiv-Ziffer 2 die Klage nicht anhängig macht, wird ihr die Entscheidgebühr definitiv auferlegt. 5. Die Regelung der Entschädigungsfolgen wird dem Gericht im ordentlichen Verfahren vorbehalten. 6. Schriftliche Mitteilung an die Parteien sowie an das Grundbuchamt C._____. 7. Eine bundesrechtliche Beschwerde gegen diesen Entscheid ist innerhalb von 30 Tagen von der Zustellung an beim Schweizerischen Bundesgericht, 1000 Lausanne 14, einzureichen. Zulässigkeit und Form einer solchen Be- schwerde richten sich nach Art. 72 ff. (Beschwerde in Zivilsachen) oder Art. 113 ff. (subsidiäre Verfassungsbeschwerde) in Verbindung mit Art. 42 und

90 ff. des Bundesgesetzes über das Bundesgericht (BGG). Der Streitwert beträgt CHF 1'171'212.--.
