Omnilex summary

The Baurekurskommission IV held that where § 158(1) PBG in conjunction with § 6 PBG requires both personal notification and official publication of an order, the appeal period is respected if the filing is handed over to the post within the last of the three running deadlines arising from personal service, publication in the cantonal official gazette, or publication in the municipal publication medium or notice board.

Omnilex headnote

§ 158 Abs. 1 PBG i.V.m.

____________________________________________________________________

Key legal question

How is the appeal period calculated when the law requires both personal notice and official publication of the order?

Extracted holding

The appeal period is preserved if the filing is handed to the post within the last of the three concurrent appeal periods: receipt of personal notice, publication in the cantonal official gazette, or publication in the municipal publication organ/bulletin board.

Extracted reasoning

Under the established practice of the building appeal commissions, where several modes of notification are mandatory, the deadline runs in parallel from each legally prescribed mode; timeliness is assessed by the last expiring of those periods.
