Limits of preliminary decisions in building permit matters

BRKE IV Nr. 0169/1999Building Appeals CourtDec 16, 1999Dismissed

Extracted by Omnilex

Omnilex summary

The decision concerns the permissible scope of a preliminary decision in building matters. The authority held that a preliminary decision cannot cover the entire building project, because this would improperly merge it with the building permit procedure. In particular, the admissibility of noise emissions from a disco and the required number of parking spaces demand detailed factual and technical clarification, including the operational concept, opening hours, and visitor capacity. Such questions are therefore reserved for the building permit stage and are not suitable for a preliminary ruling.

Omnilex headnote

Preliminary decisions in building matters are limited to questions capable of being decided without the detailed factual and technical clarifications reserved for the building permit procedure; they may not be used to determine the complete project. In particular, the admissibility of noise effects from a disco and the requisite number of parking spaces depend on project details such as operating concept, opening hours, and visitor capacity, which are typically not yet sufficiently known at the preliminary stage. To admit such issues would blur the distinction between preliminary decision and building permit and unduly expand the scope of the former.

BRKE IV Nr. 169/1999 vom 16.

Key legal question

Whether the entire building project may be decided in a preliminary decision

Extracted holding

No. A preliminary decision may not encompass the complete building project because this would blur the boundary to the building permit procedure and unduly expand the preliminary-decision instrument.

Extracted reasoning

Assessing the whole project would require the detailed factual and technical examination reserved for the building permit stage.

Key legal question

Whether the admissibility of noise impacts from a disco may be examined in a preliminary decision

Extracted holding

No. The legality of the disco's noise impacts requires comprehensive assessments and evaluations that are only possible once the project has been detailed.

Extracted reasoning

At the preliminary stage, operational concept, opening hours, visitor capacity and similar key data are usually not yet known or only insufficiently known.

Key legal question

Whether the necessary number of parking spaces may be determined in a preliminary decision

Extracted holding

No. The parking-space question also depends on detailed project planning and cannot be definitively reviewed at the preliminary stage.

Extracted reasoning

The necessary evaluation presupposes more detailed factual clarification than is typically available before the building permit stage.
