Omnilex summary

The Baurekurskommission I held that, under the current municipal building and zoning ordinance for zone W1.3, no storey-limit applies anymore. Only the maximum building height of 6.5 m and ridge height of 4 m remain relevant, and the distribution of use among roof, attic, and full storeys is free within these height limits. For a flat-roof building, parts of an extension projecting above the building-height line need not be visibly identifiable as attic storeys if the theoretical gable-roof profile is maintained. The challenged project therefore did not violate the ordinance.

Omnilex headnote

Municipal building and zoning ordinance, zone W1.3; rooftop extension on a flat-roof building; admissibility within the theoretical gable-roof profile. Where a zoning ordinance has abolished storey-number limits and only prescribes maximum building height and ridge height, the internal allocation of uses to roof, attic, and full storeys is generally free within those height profiles. For flat-roof buildings, parts of a project that rise above the building-height line need not be specifically identifiable as attic storeys, provided the theoretical profile for a permissible gable roof is respected. A project adapted to a slope, whose roof profile remains within the allowed theoretical gable-roof envelope, is not objectionable merely because part of the extension exceeds the building-height line.

BRKE I Nr. 264/1995 vom 25.

Key legal question

Whether the planned rooftop extension exceeds the permissible building height or roof profile under the municipal building and zoning ordinance.

Extracted holding

No. In zone W1.3 the ordinance no longer limits the number of storeys, only building height and ridge height. The extension remains unobjectionable because the theoretical gable-roof profile is preserved.

Extracted reasoning

Because the ordinance allows free distribution of use and storeys within the building and ridge height, a flat-roof building may be freely designed within the admissible gable-roof profile. The south portion of the extension exceeds the building-height line, but the theoretical gable-roof profile is still respected.
