Omnilex headnote

Art. 8 ECHR; admissibility and notion of interference with private and family life: the mere admission of an indictment in criminal proceedings against a person exposed to public attention does not, by itself, constitute an interference with private and family life, even if it triggers critical media coverage or offensive correspondence; absent such interference, the complaint is inadmissible.

Art. 8 CEDH.

Key legal question

Whether the admission of the indictment constituted an interference with the applicant's private and family life under Article 8 ECHR.

Extracted holding

The Commission held that the admission of the indictment did not amount to an interference with private and family life, even though it prompted critical media reports and impertinent letters.

Extracted reasoning

The challenged decision concerned the conduct of criminal proceedings against a person exposed to the public, and the ensuing media reaction was insufficient to establish an interference within the meaning of Article 8.
