Art. 6 § 2 CEDH. Présomption d'innocence.

  • Aucune violation du fait que le juge de l'arrestation saisi de la requête de mise en liberté provisoire d'un justiciable prévenu d'infraction à la législation sur les stupéfiants a pris en considération l'acte d'accusation et les aveux d'une procedure antérieure non encore close par un jugement entre en force pour motiver le risque de récidive.

  • Aucune violation du fait que le juge de l'arrestation, pour établir la durée maximale admissible de la détention provisoire, s'est basé sur la peine d'ensemble prévisible pour les deux procédures, en tenant compte aussi du jugement prononcé dans la première procédure, mais non encore entré en force.

  • Keine Verletzung dadurch, dass der Haftrichter bei der Prüfung eines Haftentlassungsgesuches eines Betäubungsmitteldelinquenten Anklageschrift und Geständnis eines früheren, noch nicht mit rechtskräftigem Urteil abgeschlossenen Verfahrens berücksichtigt hat, um eine Wiederholungsgefahr zu begründen.

  • Keine Verletzung dadurch, dass der Haftrichter im Rahmen der Ermittlung der zulässigen Höchstdauer der Untersuchungshaft auf die zu erwartende Gesamtstrafe in beiden Verfahren abgestellt hatte, wobei auch das noch nicht rechtskräftige Urteil des ersten Verfahrens berücksichtigt wurde.

  • Nessuna violazione per il fatto che il giudice d'arresto, nell'esame di una richiesta di messa in libertà provvisoria di un delinquente che ha infranto la legislazione sugli stupefacenti, ha preso in considerazione l'atto d'accusa e la confessione di una procedura precedente non ancora conclusa con una sentenza cresciuta in giudicato, per motivare il pericolo di recidiva.

  • Nessuna violazione per il fatto che il giudice d'arresto, per determinare la durata massima ammissibile del carcere preventivo, si è basato sulla pena complessiva prevedibile nelle due procedure, tenendo conto anche della sentenza non ancora cresciuta in giudicato della prima procedura.
