Omnilex summary

C.J.________ appealed a summary condemnation order by the Lausanne investigating judge that imposed a suspended fine and a conversion imprisonment term, plus costs, for insult, abusive use of a telecommunications installation, and threats. The Tribunal d'accusation held that an appeal against such an order is available only for violation of an essential procedural rule. Because the appellant’s complaints concerned the merits and the order’s reasoning on concurrence, they were inadmissible. The court noted that she should have filed an opposition to contest the conviction. The appeal was rejected, the order confirmed, and CHF 220 in costs were imposed on the appellant.

Omnilex headnote

Art. 294 let. f CPP; scope of appeal against a condemnation order: the remedy is limited to complaints alleging violation of an essential rule of procedure. Criticism directed at the substantive correctness of the conviction, including the application of criminal offences or the assessment of concurrence, is inadmissible in such appeal proceedings and must be raised by opposition to the condemnation order. Where the appellant confines herself to merits-based arguments, the appeal is to be rejected and the challenged order confirmed (consid. corresponding to admissibility). Costs may be charged to the unsuccessful appellant under Art. 307 CPP.

100 al. 1

LTF). Le greffier :

Extracted by Omnilex

Key legal question

Whether the appeal against a condemnation order was admissible beyond a procedural-law violation.

Extracted holding

The appeal could only be brought for breach of an essential procedural rule; complaints attacking the merits were inadmissible.

Extracted reasoning

The appellant relied on alleged misapplication of the criminal provisions and on insufficient reasoning regarding concurrence, but these arguments concerned the merits rather than a procedural defect. To contest the conviction itself, she had to file an opposition against the order, which she did not do.

Key legal question

Whether the lower order had to be overturned for lack of reasoning on concurrence.

Extracted holding

No; this argument was not reviewable in the present appeal because it related to the merits of the condemnation order.

Extracted reasoning

The court held that such criticism was not an essential procedural violation within the narrow scope of review under the applicable appeal provision.
