Omnilex summary

G.________ had filed a complaint against an unknown person for property damage. The public prosecutor’s office of the Nord vaudois district issued a non-entry order on 10 December 2012. After a letter from G.________ on 22 January 2013, the vice-president of the Criminal Appeals Chamber asked him to confirm by 12 February 2013 whether he intended to appeal, warning that the filing appeared late. In his 11 February 2013 reply, G.________ did not confirm an appeal but requested that the investigation be resumed. The chamber held that this amounted to an implicit waiver, took note that the 22 January letter was not an appeal, struck the case from the roll, and left the CHF 220 costs to the State.

Omnilex headnote

Art. 393 al. 1 let. a CPP, Art. 425 CPP; an appellate filing must clearly express the intent to challenge the decision. If, after a judicial invitation to clarify and a warning regarding possible lateness, the party does not expressly confirm the appeal but instead seeks merely renewed investigation, the authority may infer an implicit waiver and strike the matter from the roll. In such a situation, the appellate costs may be left to the State (consid. implicitly).

Key legal question

Whether the 22 January 2013 letter constituted an appeal against the non-entry order.

Extracted holding

The court held that the letter was not an appeal.

Extracted reasoning

After the president’s warning, the complainant did not expressly confirm a desire to appeal; instead he asked for the investigation to be resumed.

Key legal question

Whether the proceedings should be struck from the roll because the complainant implicitly waived the appeal.

Extracted holding

Yes. The court inferred an implicit waiver of the right to appeal and struck the case from the roll.

Extracted reasoning

The absence of an express confirmation, despite the court’s invitation and warning about tardiness, justified treating the matter as abandoned.

Key legal question

Allocation of the appellate costs.

Extracted holding

The appellate costs of CHF 220 were left to the State.

Extracted reasoning

Because the case was struck out following the implicit waiver, the court charged the costs to the State.
