Whether the appeal against the refusal to admit new allegations and evidence was admissible under Art. 319 CPC
The appellant did not show that the refusal could cause irreparable prejudice; the appeal was therefore not admissible.
A refusal to admit new allegations and evidence is an other decision under Art. 319 let. b CPC and is only appealable if it may cause irreparable prejudice. Such prejudice is normally absent because the party can still rely on the evidence in the merits proceedings and, if necessary, challenge the final judgment.
