Whether the appeal against the first-instance allocation of court fees and costs was admissible and well founded
The appeal was admissible but unfounded; the first-instance decision on fees and costs was upheld.
The appeal was filed in time and in proper form. After the withdrawal of the objection, the first judge had already largely taken that withdrawal into account when fixing fees and costs. Under Art. 106 CPC, the losing party bears costs; the amounts awarded were not objectionable under the applicable fee and cost tariffs.
