Art. 241 al. 3 CPC Statuant sur l’appel interjeté par A.H., à [...], défenderesse, contre le jugement rendu le 15 avril 2016 par le Tribunal civil de l’arrondissement de la Broye et du Nord vaudois dans la cause divisant l’appelante d’avec B.H., à [...], demandeur, le Juge délégué de la Cour d'appel civile du Tribunal cantonal considère :
2 - E n f a i t e t e n d r o i t : 1.Le 17 mai 2016, A.H., née [...], a déposé un appel contre le jugement rendu par le Tribunal civil de l’arrondissement de la Broye et du Nord vaudois dans la cause en modification de jugement de divorce opposant l’appelante à son ex-mari, B.H.. Par ordonnance du 21 juin 2016, le juge délégué a relevé Me Serge Demierre de sa mission d’office et a désigné en remplacement Me Laurent Fischer comme avocat d’office de A.H.________ dans la procédure d’appel l’opposant à B.H.________. Par ordonnance du même jour, le juge délégué a fixé l’indemnité d’office due au conseil d’office Me Serge Demierre. 2.Par lettre du 4 juillet 2016, l’appelante a confirmé sa déclaration de retrait d’appel du 23 juin 2016. Il convient d’en prendre acte et de rayer la cause du rôle (art. 241 al. 3 CPC [Code de procédure civile du 19 décembre 2008 ; RS 272]), ce qui relève de la compétence du juge délégué de la Cour de céans (art. 43 al. 1 let. a CDPJ [Code de droit privé judiciaire vaudois du 12 janvier 2010 ; RSV 211.02]). Par cette même lettre, Me Laurent Fischer, a renoncé à être rémunéré en tant que conseil d’office. 3.Le présent arrêt peut être rendu sans frais judiciaires (art. 11 TFJC [tarif du 28 septembre 2010 des frais judiciaires civils, RSV 270.11.5]), ni dépens.
3 - Par ces motifs, le Juge délégué de la Cour d’appel civile p r o n o n c e : I. Il est pris acte du retrait de l'appel. II. La cause est rayée du rôle. III. La bénéficiaire de l’assistance judiciaire est, dans la mesure de l’art. 123 CPC, tenue au remboursement de l’indemnité au conseil d’office versée à Me Serge Demierre selon l’ordonnance rendue le 21 juin 2016 par le Juge délégué de la Cour d’appel civile et mise à la charge de l’Etat.
