Summary

RI 1, RI 2, and RI 3 appealed against State Council decision no. 1393 approving the revision of the municipal zoning plan of Orselina. Before the Tribunal della pianificazione del territorio, RI 2 withdrew the appeal, RI 1 agreed to the withdrawal, and counsel for RI 3 also withdrew the appeal on behalf of RI 3. The court held that the proceedings were therefore exhausted, struck the appeal from the docket, and ordered that no court fees, expenses, or party compensation be levied, noting that compensation had already been settled between the parties.

la decisione 6 aprile 2004 (n. 1393), con cui il Consiglio di Stato ha approvato la revisione del piano regolatore del comune di Orselina;

preso atto che:

con lettera 24 ottobre 2005 RI 2 ha dichiarato di ritirare il ricorso;

con scritto 25/28 ottobre 2005 RI 1 ha confermato il suo accordo al ritiro dell’impugnativa;

con lettera 28 ottobre 2005 l’avv. PR 1 ha comunicato di ritirare il gravame summenzionato a nome di RI 3;

considerato pertanto:

che il procedimento è così esaurito;

che il tribunale non preleva una tassa di giudizio;

che la definizione delle ripetibili è già stata liquidata direttamente tra le parti;

decreta:

  1. Il ricorso è stralciato dai ruoli.

  2. Non si prelevano né tasse, né spese. Non si assegnano ripetibili.
