The appellant withdrew the appeal against the State Council decision concerning the forest boundary next to the buildable zone of the Municipality. The Planning Tribunal held that the case had become moot and ordered the appeal struck from the docket. It further decided that no court fees or costs would be charged. The decision was issued by the Ticino Planning Tribunal in Lugano on 5 March 2001.
Withdrawal of appeal; mootness and costs: where the appellant withdraws the appeal, the proceedings become devoid of object and the court strikes the case from the docket. In such circumstances, absent special reasons, no court fees or costs are charged (consid. 1-2).
