The appellant challenged the Cantonal Council's approval of a municipal zoning plan before the Ticino Territorial Planning Court. At the hearing on 29 August 1996, counsel declared the appeal withdrawn. The court therefore found the case moot, struck the appeal from the docket, and ordered that no court fees or costs be collected.
Appeal withdrawal; mootness and costs: if the appellant withdraws the administrative appeal at the hearing, the proceedings become without object and the court strikes the case from the docket; in such circumstances, the court may order that no fees or costs be levied.
