Summary

The Comune appealed a State Council resolution approving certain amendments to the municipal zoning plan. Before the Tribunal della pianificazione del territorio could decide, the appellant informed the court in writing that it was withdrawing the appeal. The court therefore held that the case had become moot and ordered the appeal struck off the docket. It further decided that no court fees or costs would be charged.

Withdrawal of the appeal renders the proceedings moot; the court strikes the case from the roll. Where the appellant withdraws the challenge before judgment and no live controversy remains, the court terminates the proceedings without costs, absent a basis for allocating fees otherwise.
