viste la risposta 3 ottobre 1995 del Consiglio di Stato e le osservazioni 15 maggio 1987 del Comune di __________;

letti ed esaminati gli atti;

visto che nella propria risposta il Consiglio di Stato rileva come in data 19 settembre 1995 sia entrato in vigore il nuovo PR del comune di __________ che non prevede più l’avversata zona __________, mentre la zona __________ ed il posteggio pure contestati dai ricorrenti non sono stati approvati e dovranno quindi formare oggetto di una variante, motivo per cui l’esecutivo cantonale ritiene che il ricorso sia oramai privo di oggetto;

preso atto che con lettera 7 maggio 1996 gli insorgenti dichiarano di ritirare il loro ricorso, ritenutolo superato di fatto dal nuovo atto pianificatorio;

considerato in fatto e diritto:

che il tribunale procede, d’ufficio o su richiesta di una parte, allo stralcio dei ricorsi che nel corso del procedimento diventano privi di oggetto, rispettivamente di interesse giuridico;

che a norma dell’art. 31 LPAm, applicabile in forza del richiamo dell’art. 38 cpv. 6 LALPT, il TPT condanna la parte soccombente al pagamento di un’indennità alla controparte;

che soccombente è in linea di principio l’autorità che rivede nel senso postulato dal ricorrente la decisione impugnata (acquiescenza);

che in concreto l’abbandono da parte del comune in sede di revisione del PR delle soluzioni pianificatorie contestate dai ricorrenti rende il ricorso privo di oggetto e vale acquiescenza;

che al comune devono dunque essere poste a carico ripetibili a favore dei ricorrenti, patrocinati da avvocato;

decreta

  1. Il ricorso é stralciato dai ruoli.

  2. Non si prelevano tasse e spese; il Comune corrisponderà fr. 1.000.- di ripetibili ai ricorrenti.
