Summary

The Ticino Tax Chamber of the Court of Appeal dealt with a tax appeal against a reminder fee. After the appellant notified the court on 6 August 1998 that it was withdrawing the appeal, the court found the matter had become moot. It therefore struck the case from the docket and ordered that no court costs or justice fee be charged. The decision was issued by single judge Alessandro Soldini with secretary Fiorenzo Gianinazzi.

Tax appeal withdrawn; mootness and costs: where the appellant expressly withdraws the appeal, the proceedings become devoid of object and the court strikes the case from the docket (Art. 207 cpv. 2 LT; Art. 228 LT; Art. 134 cpv. 2 and 142 cpv. 4 LIFD). In such circumstances, the court may dispense with both court costs and the justice fee. The dismissal is procedural only and does not address the merits of the tax assessment or the reminder fee.
